Abstract (English): The electric power service represents a fundamental pillar for the economic, social, and technological development of any nation. In Ecuador, its classification as an essential public service positions it as a key instrument for ensuring constitutional rights such as health, education, and public safety. However, the provision of electricity in the country has historically faced significant challenges, stemming from a strong dependence on hydroelectric generation, climate vulnerability, and the absence of coherent and sustainable energy policies. The electricity service crisis that occurred between 2023 and 2024 exposed the structural fragility of the system and the direct impact of service disruptions on both the population's quality of life and the effective enjoyment of fundamental rights. This study aimed to analyze the legal foundations that underpin State responsibility in the face of this crisis and to propose normative alternatives toward a sustainable energy transition. A qualitative, dogmatic, and analytical legal methodology was employed, based on the examination of constitutional, administrative, and environmental regulations, as well as a review of relevant jurisprudence and specialized legal doctrine. The analysis revealed that the State failed to adopt sufficient structural measures to prevent the crisis or ensure the continuity of service, thereby incurring objective and non-contractual liability for omission. It is concluded that the State bears a legal duty to ensure the sustainable provision of electric service as part of its broader obligation to safeguard fundamental rights. The energy transition must be guided by the principles of sustainability, environmental justice, and effective State accountability. [ABSTRACT FROM AUTHOR]
Abstract (Spanish): El servicio eléctrico constituye uno de los pilares fundamentales para el desarrollo económico, social y tecnológico de cualquier nación. En Ecuador, su carácter de servicio público esencial lo posiciona como una herramienta clave para garantizar derechos constitucionales como la salud, la educación y la seguridad. Sin embargo, la provisión de energía eléctrica en el país ha enfrentado históricamente desafíos significativos, procedentes de la dependencia en la generación hidroeléctrica, la vulnerabilidad climática y la ausencia de políticas energéticas coherentes y sostenibles. La crisis del servicio eléctrico ocurrida entre 2023 y 2024 ha demostrado la fragilidad estructural del sistema, así como el impacto directo de su interrupción en la calidad de vida de la población y en la vigencia de derechos fundamentales. Este estudio tuvo como objetivo analizar los fundamentos jurídicos que configuran la responsabilidad del Estado frente a dicha crisis y proponer alternativas normativas hacia una transición energética sostenible. Se realizó una investigación cualitativa, de carácter dogmático y analítico, basada en el estudio de normativa constitucional, administrativa y ambiental, así como en la revisión de doctrina especializada y jurisprudencia nacional. El análisis evidenció que el Estado no adoptó medidas estructurales suficientes para prevenir la crisis ni garantizar la continuidad del servicio, configurando responsabilidad objetiva y extracontractual por omisión. Se concluye que el Estado tiene el deber jurídico de garantizar la provisión sostenible del servicio eléctrico como parte de su obligación de proteger derechos fundamentales.
