| Abstract (English): | The ruling of the Superior Court of Justice of Asturias dated October 9, 2025, addresses the termination of a hydroelectric concession granted in 2002 for the use of 15,000 liters per second from the Saja River, due to the repeated failure to comply with the required ecological flow, caused by the blockage of the bottom outlet of the weir. The court confirms that respect for the ecological flow is an essential condition of the concession, whose breach justifies its expiration, especially when an economic benefit for the concessionaire is evident. Furthermore, the importance of critically evaluating expert evidence and the presumption of truthfulness of the reports from Environmental Agents—officials authorized to inspect and report violations—is emphasized. Finally, the obligation to demolish the works located within the hydraulic public domain after the termination of the concession is upheld, despite the initiation of proceedings to declare the area a Site of Cultural Interest, with the resolution of possible regulatory conflicts remaining outside the scope of the litigation. | Abstract (Spanish): | La sentencia de autos resuelve el recurso contencioso-administrativo interpuesto por una mercantil contra la Confederación Hidrográfica del Cantábrico (CHC), siendo codemandado el Ayuntamiento de Reocín, en relación con la extinción de la concesión para el aprovechamiento hidroeléctrico de 15.000 l/s de agua del río Saja. La concesión, otorgada en 2002 por cuarenta años, fue declarada extinguida por la CHC tras constatar, en 2022, el incumplimiento reiterado de los caudales ecológicos exigidos, debido a la obturación del desagüe de fondo del azud; situación que la Sala considera no subsanada por la parte recurrente.
