Abstract (English): Forest fires are one of the main environmental and security challenges of the 21st century, exacerbated by climate change, rural depopulation, and the growing vulnerability of Mediterranean ecosystems. Public authorities play a key role through their powers of planning, prevention, and response, which raises questions about their patrimonial liability when damages result from deficient or insufficient administrative action. This paper analyzes, from the perspective of Spanish Administrative Law, cases where administrative inactivity, lack of resources, or poor coordination among administrations may lead to liability claims. Jurisprudence from the Supreme Court and regional courts is examined, together with the principles of precaution and good administration. The study concludes with reflections on the limits of State liability regarding extraordinary natural phenomena. [ABSTRACT FROM AUTHOR]
Abstract (Spanish): Los incendios forestales constituyen uno de los principales retos ambientales y de seguridad del siglo XXI, agravados por el cambio climático, la despoblación rural y la creciente vulnerabilidad de los ecosistemas mediterráneos. Frente a este escenario, la Administración Pública desempeña un papel esencial a través de sus competencias en materia de planificación, prevención y extinción, lo que plantea interrogantes sobre el alcance de su responsabilidad patrimonial cuando los daños ocasionados pudieran derivarse de una actuación deficiente o insuficiente. El trabajo analiza, desde la perspectiva del Derecho administrativo español, los supuestos en que la inactividad, la falta de medios o la deficiente coordinación entre Administraciones pueden dar lugar a reclamaciones de responsabilidad patrimonial. Asimismo, se estudian la doctrina del Tribunal Supremo y la normativa autonómica aplicable, junto con los principios de precaución y buena administración. Finalmente, se reflexiona sobre los límites de la responsabilidad del Estado ante fenómenos naturales extraordinarios y la necesidad de articular un marco jurídico más claro y eficaz.
