| Abstract (English): | The article focuses on the ruling of the Spanish Supreme Court regarding the contentious-administrative appeal filed by "Ecologistas en Acción-CODA" against the revision of the hydrological plans of several basins, especially those of the Guadalquivir, Tajo, and Júcar, approved by Royal Decree 35/2023. The Court concludes that the Guadalquivir Hydrological Plan (HP) is incomplete because it does not include in its approval the generating flows nor the rate of change, essential elements for determining ecological flows, and orders their incorporation within eight months. Regarding the Júcar HP, it acknowledges the omission of including in the Register of Protected Areas the trout waters defined in the regional plan of Castilla-La Mancha, which must be incorporated without delay. Furthermore, it clarifies that hydrological plans must protect water bodies and not the entirety of protected natural spaces, whose conservation corresponds to a different comprehensive planning. Finally, the exemption of environmental objectives in the Guadalquivir basin for the “Las Cruces” mining operation is validated, provided that the legal and public interest conditions established in the Water Framework Directive are strictly met. | Abstract (Spanish): | El Alto Tribunal examina en este caso el recurso contencioso-administrativo interpuesto por «ECOLOGISTAS EN ACCIÓN-CODA», contra la revisión de los planes hidrológicos de las demarcaciones hidrográficas del Cantábrico Occidental, Guadalquivir, Ceuta, Melilla, Segura y Júcar, y de la parte española de las demarcaciones hidrográficas del Cantábrico Oriental, Miño-Sil, Duero, Tajo, Guadiana y Ebro, aprobados por el Real Decreto 35/2023, de 24 de enero. El recurso se ciñe a los planes de las cuencas del Tajo, Guadalquivir y Júcar, si bien la recurrente solicita la nulidad de varias de sus determinaciones e, incluso, las objeciones que formula lo son más que por el contenido de los Planes, por sus omisiones.
