Abstract (English): The article focuses on the ruling of the Superior Court of Justice of Castilla y León, which dismisses the appeal by the company Inver Generación 14, S.L. seeking exceptional use authorizations on rural land for two photovoltaic installations in Renedo de Esgueva. The Court concludes that positive administrative silence does not apply and that the denial is justified by a negative sectoral report indicating incompatibilities with urban planning regulations, territorial planning, and landscape protection. Furthermore, it is highlighted that the company did not demonstrate a specific and prevailing public interest nor justify the need to locate the plants on rural land, showing a business interest without direct benefit to the local population. Therefore, the values protected by urban and territorial legislation prevail over the mere promotion of renewable energy. [Extracted from the article]
Abstract (Spanish): La Sala examina el recurso de apelación formulado por la mercantil "Inver Generación 14, S.L.", contra la sentencia del Juzgado de lo Contencioso-Administrativo Núm. 1 de Valladolid de 17 de junio de 2024, que desestimó el recurso contencioso-administrativo formulado por aquélla contra la resolución desestimatoria del recurso de reposición de fecha 25 de enero de 2023, interpuesto por la actora contra las resoluciones de la Alcaldía del Ayuntamiento de Renedo de Esgueva de 24 de noviembre de 2022, emitidas en los expedientes administrativos relativos a la autorización de las instalaciones fotovoltaicas «Los Hornillos 1» y «Los Hornillos 2» y por las que se deniega la autorización para instalar placas fotovoltaicas en suelo rústico.
