Abstract (English): The Law 3/2026, of March 13, on Forests of Andalusia establishes the new legal framework for the organization, use, and administration of forests in this autonomous community, aligning with international commitments, European guidelines, and national and regional forest plans. The law consolidates cooperation between the regional forestry administration and local entities, creates the Andalusian Council for Forest Policy and Biodiversity, and regulates the classification, sustainable management, utilization, and conservation of public and private forests. Additionally, it incorporates a forest geographic information system, promotes training and public-private collaboration, and establishes a sanctioning regime to ensure regulatory compliance. This regulation repeals the previous Forest Law and adapts various legal provisions related to environmental protection and climate change in Andalusia. [Extracted from the article]
Abstract (Spanish): Esta nueva Ley de Montes de Andalucía constituye el nuevo marco de la política forestal en esta Comunidad Autónoma y se articula en torno a los compromisos internacionales contraídos por España, las directrices emanadas de la Unión Europea, la Estrategia Forestal Española, el Plan Forestal Español y el Plan Forestal Andaluz, sobre la base de un proceso de participación pública sin precedentes. El título I establece que el objeto de esta Ley es el establecimiento del régimen jurídico para la organización, uso y administración de los montes en la comunidad autónoma en el marco de la legislación básica estatal. Una de las principales novedades de este nuevo texto legal es la adopción de la estructura y contenido básico de la ley básica estatal. En relación con la organización administrativa local, se consolida la figura de los convenios de cooperación entre la Administración forestal autonómica y las entidades locales para la gestión de los montes de titularidad de estas últimas.
