| Abstract (Spanish): | La sentencia del Tribunal de Justicia de la Unión Europea (TJUE) del 26 de febrero de 2026 interpreta el artículo 5, letra d), de la Directiva 2009/147/CE relativa a la conservación de las aves silvestres, en relación con la perturbación intencionada y las medidas de prevención y mitigación en proyectos que puedan afectar a estas especies. El Tribunal establece que no existe perturbación intencionada si las medidas previstas evitan efectos significativos sobre las poblaciones de aves, considerando desde el inicio dichas medidas en la evaluación, a diferencia del régimen de la Directiva sobre los hábitats.
