Abstract: The article discusses the ongoing complexities surrounding the definition of "Waters of the United States" (WOTUS) as it relates to the Clean Water Act (CWA). Environmental Protection Agency (2023), which altered the criteria for determining jurisdiction over non-navigable waters. The November 2025 proposal by the Environmental Protection Agency (EPA) and the U.S. Army Corps of Engineers (USACE) suggests a narrower interpretation of what constitutes "relatively permanent" waters and includes changes to various exclusions.
