| Abstract (English): | The concept of the right to health has undergone a process of transformation in Columbia since the reform of the country's Political Constitution in 1991, resulting in Law 100, created in 1993, and Constitutional Court judgment C760, and ultimately leading to the creation of Law 1571 in 2015, which states that health is a fundamental human right. The judicialization of health has played an important role in this process, impacting Colombia's health system. This review analyzes the contribution made by Colombia's Constitutional Court to the configuration of health as a fundamental human right within the context of health litigation. A systematic review of the literature identified four analytical categories related to the reconfiguration of the legal nature of the right to health and its effects on Colombia's health system. | Abstract (Spanish): | La concepción del derecho a la salud en Colombia ha experimentado un proceso de transformación desde la reforma de su Constitución Política en 1991, pasando por la Ley 100 de 1993, la sentencia C760 de la Corte Constitucional, desembocando en la ley 1571 de 2015 que establece la salud como derecho humano fundamental. En este trayecto es importante la judicialización de la salud y sus efectos, los que impactaron el sistema de salud colombiano. El propósito de esta revisión fue analizar el aporte de la Corte Constitucional a la configuración de la salud como derecho humano fundamental en el marco del litigio en salud. Se realizó una revisión sistemática de la literatura identificando cuatro categorías analíticas relacionadas con la reconfiguración y reconceptualización de la naturaleza jurídica del derecho a la salud y sus efectos sobre el sistema de salud colombiano. | Abstract (Portuguese): | A concepção do direito à saúde na Colômbia passou por um processo de transformação desde a reforma de sua Constituição Política, em 1991, à Lei 100 de 1993, acórdão C760 do Tribunal Constitucional, levando à Lei 1571 de 2015 que estabelece a saúde como direito humano fundamental. Nessa jornada é importante a judicialização da saúde e seus efeitos, que impactaram o sistema de saúde colombiano. O objetivo desta revisão foi analisar a contribuição do Tribunal Constitucional para a configuração da saúde como um direito humano fundamental no contexto do contencioso em saúde. Foi realizada uma revisão sistemática da literatura identificando quatro categorias analíticas relacionadas à reconfiguração e recontuização da natureza jurídica do direito à saúde e seus efeitos sobre o sistema de saúde colombiano.
