Abstract (English): The knowledge society with the intensive use of information and communication technologies (ICT), emerges to the workplace in the irreversible fact of adopting new work modalities, such as the innovative and unique teleworking, evidently generating changes in the labor structure with direct impacts on the legal system, then influencing constitutional and labor rights; framework in which, through ministerial agreements, teleworking was born in Ecuador. Consequently, it was possible to scientifically reveal its constituent elements, to know its impact on Ecuadorian legislation, and the discussion of the most relevant legal aspects with regulatory approaches to consider in a possible specialized organic law, or its inclusion in the Labor Code and Organic Law of the Public Service. Abstract (Spanish): La sociedad del conocimiento con el uso intensivo de las tecnologías de la información y comunicación (TIC), emerge al ámbito laboral en el hecho irreversible de adoptar nuevas modalidades de trabajo, como el innovador y singular teletrabajo, generando evidentemente cambios en la estructura laboral con impactos directos en el ordenamiento jurídico, al incidir con derechos constitucionales y laborales; marco en el que normado por acuerdos ministeriales nació el teletrabajo en Ecuador. Consecuente a tal razonamiento, se logró develar científicamente sus elementos constitutivos, para conocer su incidencia en la legislación ecuatoriana, y la discusión de los aspectos jurídicos más relevantes con planteamientos regulatorios a considerar en una posible ley orgánica especializada, o su inserción en el Código del Trabajo y la Ley Orgánica del Servicio Público.
