Abstract (English): The article examines conflicts in contesting wills and highlights mediation as an effective alternative method to resolve them. It identifies challenges such as interpreting testamentary clauses and managing intense emotions, as well as complicated legal issues such as ambiguity in testamentary provisions and the capacity of the testator. Through interviews with lawyers and a bibliographic review, the importance of a culture of peaceful conflict resolution in Ecuador and the need to strengthen the legal framework and mediation training are emphasized. The study concludes that mediation is an effective means of resolving testamentary disputes and promotes more accessible and equitable justice. [ABSTRACT FROM AUTHOR]
Abstract (Spanish): El artículo examina los conflictos en la impugnación de testamentos y destaca la mediación como un método alternativo eficaz para resolverlos. Identifica desafíos como la interpretación de cláusulas testamentarias y la gestión de emociones intensas, además de aspectos legales complicados como la ambigüedad en las disposiciones testamentarias y la capacidad del testador. A través de entrevistas con abogados y revisión bibliográfica, se enfatiza la importancia de una cultura de resolución pacífica de conflictos en Ecuador y la necesidad de fortalecer el marco legal y la capacitación en mediación. El estudio concluye que la mediación es un medio eficaz para resolver disputas testamentarias y promueve una justicia más accesible y equitativa. [ABSTRACT FROM AUTHOR]
