Abstract:	The authors analyze whether the use of value-added modeling (VAM) as a tool for assessing teacher effectiveness have consequences for building a pathway to educational malpractice. They discuss the foundations for understanding teacher evaluation and explain the use of educational malpractice as a tort of negligence to be able to bring a legal action. They analyze the arguments over duty owed, breach of duty, causation, injury and legal defenses that all form the basis for malpractice action.
