| Abstract: | This manual and resource directory aims to help employers, other entities, and persons with disabilities learn about their obligations and rights under the employment provisions of Title I of the Americans with Disabilities Act (ADA). The manual provides guidance on the application of legal requirements established in the statute and in regulations of the Equal Employment Opportunity Commission (EEOC). The manual's 10 chapters address the following topics: (1) summary of Title I legal requirements; (2) definitions of "an individual with a disability," a "qualified individual with a disability," and "essential" job functions; (3) the obligation to make reasonable accommodation; (4) establishment of qualification standards and selection criteria that do not discriminate; (5) guidance on nondiscrimination in recruitment and selection; (6) requirements applicable to medical examinations and medical inquiries; (7) the obligation to apply ADA nondiscrimination requirements to promotion and advancement opportunities, training, evaluation, and employee benefits such as insurance; (8) requirements related to employment policies regarding drug and alcohol abuse; (9) guidance on ADA requirements as they relate to workers' compensation practices; and (10) enforcement provisions. Appendixes contain the text of Title I and Title V, EEOC regulations, and a form for ADA-related small business tax credit. The resource directory is divided into three parts, covering: federal agency programs that provide information and technical assistance on or related to the ADA and other federal nondiscrimination requirements; information on specific employment-related information and technical assistance available from national nongovernmental organizations; and locations and telephone numbers for regional and state offices of federal programs.
