| Abstract: | Except for school construction, there is no legislation to guide implementation of the programs and reforms ordered by the New Jersey Supreme Court in the landmark "Abbott v. Burke" case. Instead, in its 1998 "Abbott V decision," the Supreme Court directed the Commissioner of Education to provide standards and procedures to Abbott districts and schools for Abbott implementation through administrative regulations. The regulations govern implementation of the Abbott programs during the 2004-05 school year, and the preparation of plan and budgets for the 2005-06 school year. Education Law Center has analyzed the 2005 regulations, and issues this guide to assist advocates, parent coordinators and others working at the local and state levels to improve implementation of the Abbott programs and reforms, from kindergarten to 12th grade. This guide highlights the key areas of program implementation, new initiatives, and the responsibilities of districts and the New Jersey Department of Education. Each section includes comments on the specific regulation, and a list of "critical issues" that those involved in Abbott implementation may want to address. The comments and issues are not meant to be exhaustive, but represent issues identified by ELC or brought to their attention by parent leaders, School Leadership Council (SLC) members, teacher and principal representatives, superintendents and business administrators, and other stakeholders. |
