| Abstract (English): | The purpose of the manuscript is to analyze the types of legal liability that may be incurred by the health professional. For this we start from the medical-sanitary act that is studied from the doctrine, legislation and national jurisprudence to later link it to the concept of legal responsibility of health professionals, highlighting its elements namely: professionalism, typical standardized execution, the lawfulness and the consensual form. Finally, a normative-jurisprudential study of civil, administrative and penal responsibility is made highlighting the elements of law that are linked to the practice of health professionals. The analysis concluded the distinction by subject of the medical act (medical care) and the sanitary act (control of health) but pointing out its similarity consisting of a subjective element, that is, both are acts performed by health professionals; in this sense, they share a typology of responsibilities. The method used is legal hermeneutics, that is, the systematic interpretation of the doctrine, legislation and national jurisprudence. [ABSTRACT FROM AUTHOR] |
| Abstract (Spanish): | El propósito del manuscrito es analizar los tipos de responsabilidad jurídica en los que puede incurrir el profesional de la salud. Para ello partimos del acto médico-sanitario que es estudiado desde la doctrina, la legislación y la jurisprudencia nacional para posteriormente vincularlo al concepto de la responsabilidad jurídica de los profesionales de la salud, destacando sus elementos, a saber: la profesionalidad, la ejecución típica estandarizada, la licitud y la forma consensual. Finalmente se hace un estudio normativo-jurisprudencial de la responsabilidad civil, administrativa y penal destacando los elementos de derecho que se vinculan con la práctica de los profesionales de la salud. Del análisis se concluyó la distinción por materia del acto médico (atención médica) y del sanitario (control de sanidad), pero señalando su semejanza consistente en un elemento subjetivo, a saber: ambos son actos realizados por los profesionales de la salud; en este sentido, comparten una tipología de responsabilidades. El método utilizado es la hermenéutica jurídica, es decir, la interpretación sistemática de la doctrina, la legislación y la jurisprudencia nacional. [ABSTRACT FROM AUTHOR] |
