| Abstract (English): | The World Health Organization (WHO) reports that there are 1.3 billion people with some type of disability worldwide, who are exposed to multiple inequalities arising from the violation of their rights. Forced sterilization is one of these violations. Although girls and women with disabilities are entitled to equal rights with others, the reality is different. The Convention on the Rights of Persons with Disabilities describes the prevalence of welfare-based care, treatment based on stereotypes, prejudices, and harmful practices. Forced sterilization of girls and women with disabilities is considered a form of gender-based discrimination and violence. The United Nations also establishes that it is a form of cruel, inhuman, or degrading treatment; its prohibition is enshrined in international treaties, reforms, and national and local laws. The objective of this paper is to present the theoretical and legal basis, from a human rights and gender perspective, regarding the reasons why forced sterilization constitutes a violation of the human rights of girls and women with disabilities. | Abstract (Spanish): | La Organización Mundial de la Salud (OMS) reporta que existen en el mundo 1,300 millones de personas con algún tipo de discapacidad, quienes están expuestas a múltiples desigualdades derivadas de la vulneración de sus derechos, entre estas vulneraciones destaca la esterilización forzada. A pesar de que niñas y mujeres con discapacidad son titulares de derechos en igualdad de condiciones que las demás personas, la realidad es diferente; la Convención sobre los Derechos de las Personas con Discapacidad describe que sigue prevaleciendo la atención asistencialista, el trato basado en estereotipos, prejuicios y prácticas nocivas. La esterilización forzada realizada a niñas y mujeres con discapacidad es considerada una forma de discriminación y violencia por motivos de género, asimismo, Naciones Unidas establece que es una forma de trato cruel, inhumano o degradante; su prohibición está enmarcada en tratados internacionales, reformas, leyes nacionales y locales. El objetivo de este trabajo es presentar el sustento teórico y jurídico, con perspectiva de derechos humanos y género, respecto a los motivos por los cuales la esterilización forzada constituye una violación de derechos humanos contra niñas y mujeres con discapacidad.
