Abstract (English): When the State’s institutional structure operates a racially stratified healthcare system, it contributes to an unequal distribution of health outcomes: structural State racism. We analyze the State of Colombia´s affirmative and restorative action that included sickle cell disease as orphan disease number 751 through Resolution 2048 of 2015 by the Ministry of Health and Social Protection, under Law 1392 of 2010, as an institutional racialization process that establishes healthcare inequalities in the population of affected patients. Abstract (Spanish): Cuando a través del andamiaje institucional del Estado se opera un sistema de estratificación racializada en salud, se está contribuyendo a la distribución inequitativa de desenlaces en salud: racismo estructural del Estado. La acción afirmativa y reparativa del Estado colombiano que incluyó la anemia de células falciformes como enfermedad huérfana número 751 a través de la Resolución 2048 de 2015 por parte del Ministerio de Salud y Protección Social, bajo el amparo de la Ley 1392 de 2010 se enjuicia como un proceso de racialización institucional, determinante de inequidad del estado de salud de la población de pacientes afectados.
