As tobacco control legislation gains ground, public debate on the matter has come to be cast in constitutional terms. The present essay aims to provide information so as to participate in the debate in an informed manner. First, it explores the constitutional grounding for tobacco control. Then it analizes, one by one, the key arguments put forth to challenge the constitutionality ot tobacco control legislation, reaching the conclusion that none of the challenges holds water. Conforme ha avanzado la regulación del tabaco en México, el debate público sobre el tema se ha constitucionalizado. El presente ensayo pretende aportar elementos para participar en dicho debate de forma informada. En un primer momento, se exploran los fundamentos constitucionales de la regulación del tabaco en México. Luego, se analizan una a una las principales imputaciones de inconstitucionalidad que se han planteado a fin de cuestionar la validez de la reciente actividad legislativa en materia de regulación del tabaco, concluyendo que ninguna de ellas se sostiene.
