Abstract (English): Ecuador is a good example of the difficulties faced by States with important natural resources that search for a responsible and sustainable exploitation allowing the development of their nationals while preserving the rights of their indigenous populations. In 2008, a new Constitution entered into force recognizing nature as the subject of certain rights, among others, the fully respect its existence and the maintenance and regeneration of its life cycles, structure, functions and evolutionary processes. However, the recognition of rights is not enough for an adequate protection. Serious environmental damage as a result of past acts for which no reparation has been achieved (Chevron- Texaco Case) and quite original protection initiatives (Yasuní-ITT Project) highlight the great challenges and difficulties faced by States for the exploitation of the natural resources.
