Abstract (English): Ecuador is a good example of the difficulties faced by States with important natural resources that search for a responsible and sustainable exploitation allowing the development of their nationals while preserving the rights of their indigenous populations. In 2008, a new Constitution entered into force recognizing nature as the subject of certain rights, among others, the fully respect its existence and the maintenance and regeneration of its life cycles, structure, functions and evolutionary processes. However, the recognition of rights is not enough for an adequate protection. Serious environmental damage as a result of past acts for which no reparation has been achieved (Chevron- Texaco Case) and quite original protection initiatives (Yasuní-ITT Project) highlight the great challenges and difficulties faced by States for the exploitation of the natural resources. Abstract (Spanish): Ecuador es un buen ejemplo de las dificultades que afrontan los Estados que cuentan con importantes recursos naturales en su búsqueda de una explotación responsable y sostenible que permita el desarrollo de sus nacionales, preservando igualmente los derechos de sus poblaciones indígenas. En 2008 los ecuatorianos se dotaron de una Carta Magna que reconoce a la naturaleza como sujeto de ciertos derechos, entre otros, a que se respete integralmente su existencia y el mantenimiento y regeneración de sus ciclos vitales, estructura, funciones y procesos evolutivos. Sin embargo, reconocer derechos es insuficiente para una adecuada protección. Graves daños medioambientales consecuencia de actos pasados para los que no se ha logrado reparación (Caso Chevron-Texaco) e iniciativas ciertamente originales de protección (Proyecto Yasuní-ITT) ponen de manifiesto los grandes retos y dificultades a los que se enfrenta la explotación de los recursos naturales.
