Abstract (English): this article addresses the relationship between Business and Human Rights through the case study of an oil spill that occurred on Mompox Island, Colombia. We reconstructed the information based on fieldwork, interviews with community leaders, and the study of legal documents. Reflecting on this information, and after a brief review of the field of Business and Human Rights, we argue, drawing on authors such as Laura Bernal and Carolina Bejarano, that given the limitations of the international regulatory framework, local communities have developed their own mechanisms of justiciability through bottom-up justice practices, making use of gender-sensitive approaches. In this way, the article illustrates: i) how reparations, beyond merely restoring things to their original state, address basic needs when violations occur in contexts of high vulnerability, poverty, or inequality, ii) the extent to which legal processes fail to draw on relevant sources of International Law to address such violations, and iii) how a gender-sensitive approach, beyond being transformative, must also respect the communities' own proposals, visions, and initiatives. Abstract (Spanish): este artículo aborda la relación entre empresas y Derechos Humanos, a través del estudio de caso de un derrame petrolero ocurrido en la Isla de Mompox, Colombia. La información la reconstruimos a partir de trabajo de campo, entrevistas realizadas a líderes comunitarios y estudios de documentos jurídicos. Por medio de la reflexión en torno a dicha información y tras hacer una breve revisión del área de estudio sobre empresas y Derechos Humanos, sostenemos, en diálogo con autoras como Laura Bernal y Carolina Bejarano, que, frente a las limitaciones del marco regulatorio internacional, las comunidades locales han generado mecanismos propios de justiciabilidad mediante prácticas de justicia desde abajo, haciendo uso de aproximaciones sensibles al género. De esta manera, este artículo permite ejemplificar i) cómo las reparaciones, más allá de devolver las cosas a su estado inicial, atienden necesidades básicas cuando dichas las violaciones ocurren en contextos de alta vulnerabilidad, pobreza o desigualdad; ii) en qué medida los procesos jurídicos no se apoyan en las fuentes del derecho internacional pertinentes para abordar este tipo de violaciones, y iii) cómo una aproximación sensible al género, más allá de ser transformadora, debe ser respetuosa de las propuestas, visiones e iniciativas propias de las comunidades.
