Abstract (English): The article analyzes the relationship between citizens' fear of crime in Chile, the reality of the penitentiary system, and the possibilities for social reintegration, with special emphasis on women deprived of their liberty. It highlights that, despite a high social perception of insecurity, victimization rates do not fully justify the increase in incarceration, which predominantly affects people of low income and those convicted of low-risk offenses. The serious prison situation is underscored, characterized by overcrowding, degrading conditions, and the influence of criminal gangs within the prisons. Additionally, the double stigma faced by women in prison is addressed, linking their incarceration to trajectories of poverty, violence, and gender roles. Finally, the text proposes clemency, understood as "the moderation of the spirit in the exercise of punishment" (according to Seneca), as a necessary principle to prevent justice from becoming cruelty, promoting reintegration and respect for human dignity. Abstract (Spanish): El artículo analiza la relación entre el temor ciudadano a la delincuencia en Chile, la realidad del sistema penitenciario y las posibilidades de reinserción social, con especial énfasis en las mujeres privadas de libertad. Destaca que, pese a una percepción social elevada de inseguridad, las tasas de victimización no justifican plenamente el aumento del encarcelamiento, el cual afecta mayoritariamente a personas de bajos recursos y con delitos de baja peligrosidad. Se subraya la grave situación carcelaria, caracterizada por hacinamiento, condiciones indignas y la influencia de bandas criminales dentro de las prisiones. Además, se aborda el doble estigma que enfrentan las mujeres en prisión, vinculando su encarcelamiento con trayectorias de pobreza, violencia y roles de género. Finalmente, el texto propone la clemencia, entendida como “la moderación del ánimo en el ejercicio del castigo” (según Séneca), como un principio necesario para evitar que la justicia se convierta en crueldad, promoviendo la reinserción y el respeto a la dignidad humana.
