| Abstract (English): | The article analyzes legal responsibility in the use of Artificial Intelligence (AI) in modern warfare, highlighting the legal and ethical gaps posed by this technology in autonomous weapon systems. Although AI is indirectly regulated by international law, there are challenges in determining who should be held accountable for errors or damages caused by autonomous weapons, whether programmers, military commanders, or States. It is emphasized that AI must be subject to existing regulatory frameworks, such as international humanitarian law and human rights law, but that these are insufficient in the face of rapid technological innovation. Furthermore, risks are warned about, such as the loss of human moral judgment, bias in AI systems, and the need to preserve human oversight to ensure ethical and responsible use in armed conflicts. Aunque la IA está regulada indirectamente por el derecho internacional, existen desafíos para determinar quién debe responder por errores o daños causados por armas autónomas, ya sea programadores, comandantes militares o Estados.
