Even so, the increase in health guardianship actions continues, and these, in addition to having been consolidated as an indicator of the appropriation of fundamental rights, have been established as an indicator of accessibility to health services. This article makes a reflection on the monetary value of the direct costs of tutelage actions for two state institutions, one of the Public Prosecutor's Office called personality as an advisory body and another one assigned to the judicial branch of Colombia called distribution y court. In general, the guardianships can go through several instances according to their resolution, however, for this case only reflect with the information of the first judicial instance to be able to extrapolate the calculations to the National level, that is, advice for the writ of a guardianship and the reception and analysis of the case in a court, with the first instance ruling and notifications; all this, derived from a retrospective analysis, adjusted to present values of 2016. According to the Ombudsman's Office, from 1992 to 2016, 5,865,665 have been filed, representing constant prices of 2016, more than 4.3 billion pesos (COP $ 4,336,890,408,097). With these resources could be paid more than 114 million appointments for general medicine, that is, almost 3 consultations of general medicine per capita of Colombia, which means that these costs are increasingly transaction and paradoxically, end up generating great inefficiencies economic to the Colombian State that, in addition to the detriment represented in the health of patients, assumes the cost of the restitution of a right of access paid in advance by users and the State. |
