| Abstract (English): |
The article focuses on a ruling from the Court of Justice of the European Union (CJEU) dated January 21, 2025, which addresses the transfer of waste generated on board a ship following a breakdown at sea. The case involves the ship Flaminia, which suffered a fire and explosions while transporting containers, some of which contained hazardous materials. The ruling determines that the waste generated on board, which remains on the ship for transfer to another port, is not exempt from the prior written notification and authorization procedures under Regulation No. 1013/2006, even though it is considered waste from "normal operations." This underscores the importance of regulation in the management of hazardous waste to protect human health and the environment. [Extracted from the article] |
