The article focuses on the ruling of the Superior Court of Justice of Cantabria dated March 31, 2025, which addresses a contentious-administrative appeal filed by the Platform for the Defense of Southern Cantabria against the authorization for the installation of the El Escudo wind farm on non-urbanizable land. The platform argued the lack of informed participation from those affected and the omission of strategic environmental assessment, among other points. The Court determined that its jurisdiction was limited to the specific authorization and concluded that there was no violation of urban planning regulations, considering that the installations are of public interest. Additionally, it was mentioned that Spanish legislation does not require requirements for regional-scale wind energy plans, which excludes the application of Directive 2001/42/EC on environmental impact assessment. El pronunciamiento que analizamos resuelve el recurso contencioso-administrativo interpuesto por la Plataforma para la Defensa del Sur de Cantabria contra la autorización para la instalación del parque eólico El Escudo en suelo no urbanizable de varios municipios. La parte recurrente argumenta la falta de participación informada de los afectados, aludiendo al catálogo de Montes de Utilidad Pública (MUP) y su propiedad pública, así como a la autorización para una ocupación industrial de montes del Catálogo de Utilidad Pública (CUP).
