| Abstract (English): | The paper examines the evolution of public procurement regulation in light of the increasing integration of environmental and social sustainability objectives. It focuses on the comparison between the Italian Public Contracts Code and the upcoming revision of the EU directives. The analysis explores the role of social and environmental clauses in the current Italian framework and highlights critical issues and prospects related to award criteria, especially the centrality of the most economically advantageous tender. The article also investigates potential convergences between the Italian model and emerging EU regulatory trends, envisioning a shift toward more binding and harmonized rules that can strengthen the strategic use of public procurement to promote innovation, resilience, and sustainability. | Abstract (Spanish): | El artículo analiza la evolución de la normativa sobre contratación pública en el contexto de la creciente integración de objetivos de sostenibilidad ambiental y social, centrándose en la comparación entre el Código de Contratos Público italiano y el proceso de revisión de las directivas europeas. Se examina el papel de las cláusulas sociales y ambientales en el nuevo marco normativo italiano y se identifican tanto las principales críticas como las oportunidades relacionadas con los criterios de adjudicación, en particular la relevancia de la oferta económicamente más ventajosa. El estudio explora posibles convergencias entre el modelo italiano y las tendencias regulatorias emergentes en la UE, planteando una evolución hacia normas más vinculantes y armonizadas que fortalezcan el uso estratégico de la contratación pública para fines de innovación, resiliencia y sostenibilidad. | Abstract (Portuguese): | Il contributo analizza l'evoluzione della disciplina degli appalti pubblici nel contesto della crescente integrazione di obiettivi di sostenibilità ambientale e sociale, con particolare riferimento al confronto tra il Codice dei contratti pubblico italiano e il processo di revisione delle direttive europee. Dopo aver esaminato il ruolo delle clausole sociali e ambientali nel nuovo Codice italiano, si evidenziano criticità e prospettive legate ai criteri di aggiudicazione, sottolineando l'importanza dell'offerta economicamente più vantaggiosa. Il saggio esplora, inoltre, le possibili convergenze tra il modello italiano e le linee evolutive del diritto europeo, ipotizzando un passaggio verso una regolazione più vincolante e armonizzata, in grado di rafforzare l'utilizzo strategico della contrattazione pubblica per finalità di innovazione, resilienza e sostenibilità.
