Abstract (English): Law 2/2026, of March 12, on Environmental Management of Andalusia establishes an updated legal framework for environmental prevention, protection, and control in the Autonomous Community of Andalusia, aligned with the 2030 Agenda and the Sustainable Development Goals. The regulation promotes administrative simplification, public participation, inter-administrative cooperation, and public-private shared responsibility, as well as strengthening environmental monitoring and control. It regulates key instruments such as strategic environmental assessment, integrated and unified environmental authorization, and establishes specific measures for the management of atmospheric, light, noise, and waste pollution. Likewise, it incorporates tax incentives, environmental liability, and a sanctioning regime that includes the possibility of substituting fines with environmental services. The law will come into effect on June 20, 2026, and repeals previous regulations related to environmental management in Andalusia. [Extracted from the article]
Abstract (Spanish): La presente Ley para la Gestión Ambiental de Andalucía nace con el objetivo de dar respuesta a los retos ambientales del siglo XXI, avanzando hacia un modelo de desarrollo más justo y sostenible, siendo el medio jurídico que garantice un elevado nivel de protección de las personas y el medio ambiente, desplegando los instrumentos adecuados para prevenir, minimizar, corregir y controlar la contaminación, favoreciendo la eficiencia en el uso de los recursos y las materias primas. En coherencia con la Agenda 2030 y los Objetivos de Desarrollo Sostenible, la ley aspira a hacer compatibles la mejora de la calidad ambiental y el desarrollo social y económico, alineándose con los compromisos internacionales adquiridos por España. La ley tiene por objeto la actualización y adecuación del marco normativo ambiental de Andalucía a los cambios acontecidos en la normativa estatal y comunitaria, estableciendo el régimen jurídico aplicable en materia de prevención y protección ambiental en el territorio de la Comunidad Autónoma de Andalucía.
