Abstract: This article presents a current state of generative artificial intelligence (genAI) outputs and copyright protection. The article details the United States Copyright Office’s statements and policies on human authorship and copyrightability in works involving genAI outputs. Stephen Thaler and Kris Kashtanova and their interactions with the Copyright Office as well as relevant court cases are discussed. The article then discusses the theory of authorship by adoption, creative prompting and expressive inputs.
