Abstract:	The article presents the author's opinion on the articles of Richard Epstein and Erin Murphy concerning the third party rule. The author cites the notion of Epstein on the third party doctrine including his focus on the first principles to explain the meaning of reasonable expectation and on the consequences of the application of the rule. He criticizes the assumption of Murphy on the role of substitution effects and negates his idea on the occurrence of crimes without third parties.
