The article discusses the decision of the U.S. Supreme Court in the cases of Iqbal and In re Seagate Technology LLC which heighten the standard for the Federal Rule of Civil Procedure 8(a) (2) pleadings and the shift of the Federal Circuit from a negligence to a recklessness standard for proving willful patent infringement. It provides a review of the plausibility-standard language. It evaluates the standard for willful patent infringement compared to the standard of the intellectual property. |
