Abstract (English): This article focuses on the study and analysis of the legal figure of the substitute caregiver in Ecuadorian labor law, examining it from the interpretative criteria of enhanced protection and job security established by the jurisprudence of the Constitutional Court of Ecuador. It also explores the principles of progressive realization of fundamental rights and legal certainty that protect the substitute caregiver under national legislation. The research is based on a theoreticalmethodological and normative-jurisprudential approach, through the compilation and analysis of ratio decidendi using bibliographic records. This allowed for the evaluation of the pro persona and favorability criteria, which reinforce the substitute caregiver's job security. It concludes that the substitute caregiver has differentiated legal protections, designed to safeguard the fundamental rights of the individuals requiring their care. The Constitutional Court has examined the productive roles associated with caregiving both within and outside the workplace and domestic sphere, recognizing the need to guarantee stability to ensure the care of others. Furthermore, in several rulings, the Court has analyzed the double burden of work and family responsibilities borne by substitute workers, reaffirming the obligation to provide them with differentiated protection to prevent abrupt dismissals. It also emphasizes the State's responsibility to guarantee an adequate compensation process should such dismissal occur. [ABSTRACT FROM AUTHOR]
Abstract (Spanish): El presente artículo se enfoca en el estudio y análisis de la figura jurídica del sustituto en el derecho laboral ecuatoriano, examinándose desde los criterios interpretativos de la protección reforzada y la estabilidad laboral establecidos por la jurisprudencia de la Corte Constitucional del Ecuador. Asimismo, explora los principios de progresividad de los derechos fundamentales y de seguridad jurídica que amparan al sustituto bajo la legislación nacional. La investigación se sustenta en un enfoque teórico-metodológico y normativojurisprudencial, mediante la recopilación y análisis de ratio decidendi a través de fichas bibliográficas. Esto permitió evaluar los criterios pro persona y de favorabilidad, los cuales refuerzan la estabilidad laboral del sustituto. Se concluye que el sustituto cuenta con protecciones jurídicas diferenciadas, diseñadas para salvaguardar los derechos fundamentales de las personas que requieren su cuidado. La Corte Constitucional ha examinado los roles productivos asociados al cuidado tanto dentro como fuera del ámbito laboral y doméstico, reconociendo la necesidad de garantizar estabilidad para asegurar el cuidado de terceros. Además, en diversas sentencias, la Corte ha analizado la doble carga laboral y familiar que recae sobre el sustituto, reafirmando la obligación de otorgarle una protección diferenciada para evitar desvinculaciones abruptas. Abstract (Portuguese): Este artigo centra-se no estudo e na análise da figura jurídica do cuidador substituto no direito do trabalho equatoriano, examinando-a a partir dos critérios interpretativos de proteção reforçada e segurança laboral estabelecidos pela jurisprudência do Tribunal Constitucional do Equador. Explora também os princípios da realização progressiva dos direitos fundamentais e da segurança jurídica que protegem o cuidador substituto na legislação nacional. A pesquisa baseia-se numa abordagem teórico-metodológica e normativojurisprudencial, através da compilação e análise de ratio decidendi utilizando registros bibliográficos. Isso permitiu a avaliação dos critérios pro persona e favorabilidade, que reforçam a segurança laboral do cuidador substituto. Conclui-se que o cuidador substituto possui proteções jurídicas diferenciadas, destinadas a salvaguardar os direitos fundamentais das pessoas que necessitam de seus cuidados. O Tribunal Constitucional examinou os papéis produtivos associados ao cuidado, tanto dentro como fora do ambiente de trabalho e da esfera doméstica, reconhecendo a necessidade de garantir a estabilidade para assegurar o cuidado de terceiros. Além disso, em diversas decisões, o Tribunal analisou a dupla jornada de trabalho e responsabilidades familiares suportada pelos trabalhadores substitutos, reafirmando a obrigação de lhes proporcionar proteção diferenciada para evitar demissões abruptas.
