Laws, Policies and Program Identifiers: Individuals with Disabilities Education Act Part H
Abstract: This paper discusses how states and jurisdictions define "developmental delay" and "at risk" in their definition of eligibility for services to infants and toddlers under Part H of the Individuals with Disabilities Education Act. It reviews the procedures and criteria used to determine developmental delay and outlines the categories of risk for adverse developmental outcomes (established risk, biological/medical risk, environmental risk, and single versus multiple risk factors). A nine-page table displays a summary of states' policies regarding the definition of developmental delay and their approaches to serving at-risk children. This table indicates the status of each state's participation in Part H, state criteria for developmental delay, eligible at-risk categories, and comments. (JDD)
