Abstract (English): Informed consent is a fundamental right, it is one of the most important contributions of legal science, and it is the greatest expression of the right to personal freedom. The doctor-patient relationship has gone through widely varying historic and social circumstances. Mexico has unquestionably made great strides in consecrating that right in its modern legislation. The history of the doctor-patient relationship through the first half of the 20th Century presents us with an asymmetrical situation, product of a paternalistic vision born of the charitable perspective of ancient Greek medicine. Some historical turning points led modern society to question that supposed charitable intention, causing it to evolve and leave behind its imperative nature, assuming a new form which constitutes and operates as a true legal act, in which informed consent is seen as an expression of the patient's autonomy, closely related to information. Informed consent is an act the observance of which is considered mandatory, not bureaucratic, and omission of which should be considered an act of medical malpractice which can create liability. Abstract (Spanish): El Consentimiento Informado es un derecho fundamental, es una de las aportaciones más importantes de la ciencia jurídica, es la mejor expresión del derecho a la libertad personal. La relación médico-paciente ha pasado por muy distintas circunstancias históricas y sociales. Es indudable que México ha dado grandes pasos hasta plasmar este derecho en la legislación vigente. La historia de la relación médico-paciente hasta la primera mitad del siglo XX nos muestra una situación asimétrica, fruto de una visión paternalista surgida desde una perspectiva de beneficencia de la medicina griega. Algunos hitos en la historia llevaron a la sociedad moderna a cuestionarse esa supuesta beneficencia, por lo que ha ido evolucionado y dejando atrás este carácter imperativo, cediendo a una nueva forma que constituye y conforma un verdadero acto jurídico concibiéndose, así, el Consentimiento Informado basado en la autonomía del paciente e íntimamente relacionado con la información. El Consentimiento Informado es un acto cuya elaboración es obligatoria, no burocrática; su omisión debe considerarse como una mala práctica médica que puede generar responsabilidades.
