Abstract (English): Interest in the study of proper toxic effects of chemicals related to the work activity has aroused great interest in the scientific community, being particularly complex legal medical aspect that relates to the work injury and compensation procedures according to the laws of each country. It is done in this paper a comparative in preventive legislation in these areas in Mexico and Spain, which shows the similarity in the definitions of occupational injury, work accident and work / occupational disease, with listings closed in both countries although the requirements for declaring a work injury and are more restrictive in Spain. In any case requires a coordinated, consistent and collaborative preventive work with a broader knowledge of causal substances, harmful effects on workers and industrial processes that produce them.
