Abstract (English): Interest in the study of proper toxic effects of chemicals related to the work activity has aroused great interest in the scientific community, being particularly complex legal medical aspect that relates to the work injury and compensation procedures according to the laws of each country. It is done in this paper a comparative in preventive legislation in these areas in Mexico and Spain, which shows the similarity in the definitions of occupational injury, work accident and work / occupational disease, with listings closed in both countries although the requirements for declaring a work injury and are more restrictive in Spain. In any case requires a coordinated, consistent and collaborative preventive work with a broader knowledge of causal substances, harmful effects on workers and industrial processes that produce them. Abstract (Spanish): El interés por el estudio de los efectos tóxicos propios de las sustancias químicas relacionadas con la actividad laboral ha despertado gran interés en la comunidad científica, siendo de especial complejidad el aspecto médico legal que los relaciona con el daño laboral y procedimientos de compensación derivados de la legislación de cada país. Se realiza en este trabajo una comparativa en la legislación preventiva vigente en estos aspectos en México y España, que pone de manifiesto la similitud en las definiciones de daño laboral, accidente de trabajo y enfermedad laboral/profesional, con listados cerrados en los dos países, aunque los requisitos para declarar un daño como laboral son más restrictivos en España. En todo caso se requiere de un trabajo coordinado, homogéneo y de colaboración preventiva, con un más amplio conocimiento de las sustancias causales, efectos lesivos para los trabajadores y procesos industriales que producen.
