Abstract (English): Introduction: This research article highlights the importance of judicial activism, as well as the need for adequate judicial control over the rulings of the Constitutional Court. Although this activism represents a significant advance for the rule of law in Colombia, it is essential to analyze its impact and scope in the national context. Objective: to determine the characteristics, manifestations and effects of the judicial activism exercised by the Colombian Constitutional Court in the normative development and consolidation of the rule of law. Methodology: a qualitative documentary research methodology is used, based on the analysis of various pronouncements of the Court on the concept of judicial activism and its contribution to the evolution of different rights in Colombia. Conclusions: judicial activism has been determinant in the recognition and strengthening of fundamental rights, such as the right to abortion, the right to a healthy environment, gender equality, the right to die with dignity and the right to a survivor's pension for same-sex couples. Abstract (Spanish): Introducción: El presente artículo de investigación resalta la importancia del activismo judicial, así como la necesidad de un adecuado control judicial sobre las sentencias de la Corte Constitucional. Si bien este activismo representa un avance significativo para el Estado de derecho en Colombia, es fundamental analizar su impacto y alcances en el contexto nacional. Objetivo: determinar las características, manifestaciones y efectos del activismo judicial ejercido por la Corte Constitucional colombiana en el desarrollo normativo y la consolidación del Estado de derecho. Metodología: se emplea una metodología de investigación documental de carácter cualitativo, basada en el análisis de diversos pronunciamientos de la Corte sobre el concepto de activismo judicial y su contribución a la evolución de distintos derechos en Colombia. Conclusiones: el activismo judicial ha sido determinante en el reconocimiento y fortalecimiento de derechos fundamentales, tales como el derecho al aborto, el derecho a un ambiente sano, la igualdad de género, el derecho a morir con dignidad y el derecho a la pensión de sobreviviente para parejas del mismo sexo. Abstract (Portuguese): Introdução: Este artigo de pesquisa destaca a importância do ativismo judicial, bem como a necessidade de um controle judicial adequado sobre as decisões do Tribunal Constitucional. Embora esse ativismo represente um avanço significativo para o Estado de Direito na Colômbia, é essencial analisar seu impacto e alcance no contexto nacional. Objetivo: determinar as características, manifestações e efeitos do ativismo judicial exercido pela Corte Constitucional colombiana no desenvolvimento normativo e na consolidação do Estado de Direito. Metodologia: é utilizada uma metodologia qualitativa de pesquisa documental, baseada na análise de diversos pronunciamentos da Corte sobre o conceito de ativismo judicial e sua contribuição para a evolução de diferentes direitos na Colômbia. Conclusões: o ativismo judicial tem sido decisivo para o reconhecimento e o fortalecimento de direitos fundamentais, como o direito ao aborto, o direito a um ambiente saudável, a igualdade de gênero, o direito de morrer com dignidade e o direito a uma pensão de sobrevivência para casais do mesmo sexo.
